Welcome to UpliftUS Collective ("Nonprofit," "we," "us," or "our"). These Terms of Service ("Terms") govern your access to and use of www.upliftuscollective.org, including our website, online services, donation pages, event registration pages, virtual events, educational materials, resources, communications, and other services we make available (collectively, the "Services").

By accessing or using the Services, making a donation, registering for or participating in an event, requesting resources, submitting information, or otherwise interacting with the Services, you agree to be bound by these Terms. If you do not agree with these Terms, please do not use the Services.

1. Use of Our Services

The Services are provided to support the Nonprofit's mission, programs, events, educational activities, fundraising efforts, and community resources.

You agree to use the Services only for lawful purposes and in accordance with these Terms.

You may not use the Services:

  • For any unlawful, fraudulent, or abusive purpose.

  • To violate any applicable law or regulation.

  • To interfere with or disrupt the operation or security of the Services.

  • To attempt to gain unauthorized access to accounts, systems, networks, or information.

  • To impersonate another person or organization.

  • To submit information that you know to be false, misleading, or fraudulent.

  • To transmit viruses, malware, or other harmful code.

3. Donations

The Nonprofit accepts donations through the Services and through third-party donation or payment platforms.

When you make a donation, you agree that:

  • The information you provide is accurate and complete.

  • You are authorized to use the payment method provided.

  • The transaction information you submit may be processed by our payment provider.

  • Your donation may be subject to the terms and policies of the applicable payment processor.

Unless otherwise stated at the time of donation, donations are generally made voluntarily to support the Nonprofit's charitable mission and programs.

Donation transactions may be processed by third-party payment providers. We are not responsible for errors, outages, delays, or security incidents attributable to a third-party payment processor, although we may assist in resolving transaction issues when reasonably possible.

Where required by law, the Nonprofit may provide a donation receipt or acknowledgment.

Information regarding donations is also subject to our Privacy Policy.

4. Event Registration and Participation

The Nonprofit may offer in-person and virtual events, workshops, educational programs, meetings, fundraisers, and other activities.

When you register for an event, you agree to provide accurate and current information and to comply with any event-specific rules or requirements.

Certain events may have additional terms relating to:

  • Registration requirements.

  • Fees or donations.

  • Attendance limits.

  • Cancellation or refund policies.

  • Age requirements.

  • Health or safety requirements.

  • Accessibility accommodations.

  • Photography, video, or audio recording.

  • Participant conduct.

Event-specific terms or instructions provided during registration are incorporated into these Terms to the extent applicable.

The Nonprofit reserves the right to modify, postpone, relocate, or cancel an event when reasonably necessary, including because of circumstances outside our control.

5. Virtual Events and Online Programs

Virtual events and programs may be hosted using third-party platforms or services.

Your participation may require you to create an account with the applicable platform and agree to that platform's terms and privacy policy.

When participating in a virtual event or program, you agree to:

  • Follow the instructions provided by event organizers.

  • Treat other participants, speakers, staff, and volunteers respectfully.

  • Avoid disruptive, abusive, threatening, discriminatory, or harassing conduct.

  • Avoid sharing private or confidential information belonging to other participants.

  • Not record, distribute, or retransmit an event unless expressly authorized to do so.

  • Not use the event or platform for unauthorized advertising, solicitation, or commercial activity.

We may remove a participant from a virtual event or program if their conduct violates these Terms or interferes with the event or other participants.

6. Resources and Educational Information

The Nonprofit may provide educational materials, articles, guides, publications, referrals, links, videos, and other resources through the Services.

These resources are provided for general informational and educational purposes. Unless expressly stated otherwise, the information provided through the Services is not intended to constitute professional, medical, legal, financial, mental-health, or other specialized advice.

You should consult an appropriately qualified professional for advice concerning your individual circumstances when appropriate.

The availability of a resource, referral, organization, service provider, or external website through our Services does not necessarily constitute an endorsement or recommendation by the Nonprofit.

7. User-Submitted Information and Content

You may have opportunities to submit information, comments, feedback, testimonials, photographs, documents, questions, survey responses, or other materials through the Services ("User Content").

You remain responsible for the User Content you submit.

By submitting User Content, you represent that:

  • You have the right to provide the content.

  • The content does not knowingly violate applicable law.

  • The content does not infringe another person's intellectual property, privacy, publicity, or other rights.

  • The content does not contain malicious software or code.

You grant the Nonprofit a non-exclusive, worldwide, royalty-free license to use, reproduce, store, and display User Content as reasonably necessary to operate, administer, improve, and promote our Services, programs, or mission, subject to our Privacy Policy and any specific consent or terms provided when the content is submitted.

We may remove User Content that we reasonably believe violates these Terms or is otherwise inappropriate for the Services.

8. Photography, Video, and Audio

The Nonprofit may photograph, record, or otherwise document certain in-person or virtual events, programs, or activities.

Where applicable, we will provide notice regarding recording or photography and any available consent or participation options.

By participating in an event or activity where recording or photography has been appropriately disclosed, you acknowledge that your image, voice, or likeness may appear in photographs, recordings, or other documentation of the event, subject to applicable law and any applicable notices or consent requirements.

If a particular event has separate media-release terms, those terms will govern to the extent they conflict with this section.

9. Intellectual Property

The Services and their contents, including but not limited to text, articles, graphics, logos, photographs, videos, educational materials, designs, software, documents, and other materials, may be owned by or licensed to the Nonprofit and are protected by applicable intellectual property laws.

Unless we expressly state otherwise, you may access and use materials made available through the Services for your personal, non-commercial, educational, or other authorized use consistent with our mission.

You may not reproduce, modify, distribute, publicly display, sell, license, or create derivative works from our copyrighted materials or other intellectual property without our prior written permission, except where permitted by applicable law.

The Nonprofit's name, logos, trademarks, service marks, and other branding may not be used without prior written permission.

10. Third-Party Services and Links

The Services may contain links to or integrations with third-party websites, applications, payment processors, event platforms, social media services, or other services.

Third-party services are governed by their own terms and privacy policies.

We do not control and are not responsible for the availability, content, security, privacy practices, or policies of third-party services.

A link or integration does not necessarily constitute an endorsement, sponsorship, or recommendation by the Nonprofit.

11. Privacy

Your use of the Services is also governed by our Privacy Policy, which explains how we collect, use, disclose, and protect personal information.

By using the Services, you acknowledge that you have had an opportunity to review our Privacy Policy.

12. Accuracy of Information

We make reasonable efforts to provide accurate and current information through the Services. However, information may occasionally contain errors, omissions, outdated information, or inaccuracies.

We do not guarantee that all information provided through the Services is complete, accurate, current, or suitable for your particular circumstances.

  • The Services will meet your individual requirements.

  • The Services will be continuously available or uninterrupted.

  • The Services will be free from errors, viruses, or other harmful components.

  • Information provided through the Services will always be accurate, complete, or current.

  • Any particular resource, program, event, or service will produce a particular result.

15. Limitation of Liability

To the fullest extent permitted by applicable law, the Nonprofit and its directors, officers, employees, volunteers, agents, affiliates, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from or related to your use of, or inability to use, the Services.

This includes, to the extent permitted by law, damages arising from:

  • Your use of or reliance on information or resources provided through the Services.

  • Your participation in an event or program.

  • Your use of a third-party website, platform, or service.

  • Interruptions or unavailability of the Services.

  • Unauthorized access to or alteration of information.

  • Errors, omissions, or inaccuracies in content.

Nothing in these Terms is intended to exclude or limit liability that cannot legally be excluded or limited under applicable law.

16. Indemnification

To the extent permitted by applicable law, you agree to defend, indemnify, and hold harmless the Nonprofit and its directors, officers, employees, volunteers, agents, affiliates, and service providers from claims, liabilities, damages, losses, costs, and expenses, including reasonable attorneys' fees, arising out of or related to:

  • Your violation of another person's rights.

  • User Content you submit.

17. Termination

We may suspend or terminate your access to the Services if we reasonably believe that you have violated these Terms, engaged in unlawful or harmful conduct, or otherwise misused the Services.

You may stop using the Services at any time.

The Nonprofit may update these Terms from time to time to reflect changes in our Services, programs, events, technology, practices, or applicable law.

The updated Terms will become effective on the date indicated at the beginning of the Terms.

Your continued use of the Services after updated Terms become effective constitutes your acceptance of the updated Terms, to the extent permitted by applicable law.
